1. Acceptance of Terms

By downloading, accessing, or using StudyDuo ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the App.

2. Description of Service

StudyDuo is a mobile application that helps users stay focused by connecting them with accountability partners in real time. Features include focus timers, partner matching, scheduled sessions, chat, analytics, achievements, and goal tracking.

3. Eligibility

You must be at least 13 years of age (or 16 in the European Economic Area) to use StudyDuo. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

StudyDuo offers a free tier and a premium subscription ("Premium"). Premium is available as a monthly ($4.99/month) or annual ($49.99/year) subscription.

7. Free Trial

Premium may include a free trial period (currently 14 days). During the trial, you have full access to Premium features. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription and you will be charged. Free trial eligibility is limited to one trial per Apple ID or Google account.

StudyDuo may offer a referral program that rewards both the referrer and the referred user with free Premium access (currently 21 days each). Referral rewards are subject to the following conditions:

You retain ownership of content you create (messages, session descriptions, profile information). By posting content, you grant StudyDuo a non-exclusive, worldwide, royalty-free license to display and transmit that content as necessary to operate the service.

We reserve the right to remove content that violates these Terms or our community guidelines without prior notice.

10. Intellectual Property

The App, including its design, code, graphics, achievement artwork, avatar illustrations, and branding, is the property of StudyDuo and is protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the App without our written permission.

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the App will be uninterrupted, error-free, or secure.

13. Limitation of Liability

To the maximum extent permitted by applicable law, StudyDuo and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, including but not limited to loss of data, loss of profits, or interruption of service.

In jurisdictions that do not allow the exclusion of certain warranties or limitation of liability, our liability is limited to the maximum extent permitted by law.

14. Dispute Resolution

If a dispute arises between you and StudyDuo, we encourage you to first contact us at support@studyduo.app to seek an informal resolution.

If we cannot resolve the dispute informally, both parties agree to resolve any claims through binding arbitration on an individual basis, rather than in court, except that either party may bring claims in small claims court if eligible. Class actions and class arbitrations are not permitted.

You may opt out of this arbitration provision by notifying us in writing within 30 days of first using the App.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. If you are a consumer in the European Economic Area, you retain the protection of mandatory provisions of the law of your country of residence.

Your use of the App is also subject to the terms and policies of the platform through which you access it:

You acknowledge that Apple and Google are third-party beneficiaries of these Terms and may enforce them. Apple and Google have no obligation to provide maintenance or support for the App.

17. Changes to Terms

We may update these Terms from time to time. We will notify users of significant changes through the App or via email at least 14 days before they take effect. Continued use after changes constitutes acceptance of the updated Terms. If you do not agree with the changes, you must stop using the App.

18. Termination

You may delete your account at any time from the Profile screen. Upon deletion, your data will be removed in accordance with our Privacy Policy.

We may terminate or suspend your account immediately if you violate these Terms. Upon termination, your right to use the App ceases, but provisions that by their nature should survive (including Sections 9, 10, 12, 13, 14, 15) will remain in effect.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and StudyDuo regarding the use of the App and supersede any prior agreements.
